Do you have a timeshare in Spain?

If the answer is yes, then you need to organise a Spanish Will for this.

Without one in place, it will cause considerable hassle for your beneficiaries and will also mean that your Spanish estate will fall under forced Spanish heirship rules which will means as examples:

  1. You are unable to leave your time share to a spouse – they can only receive what is known as an usufructo right to use it, they cannot own it, meaning that they cannot sell it or otherwise dispose of it;

  2. You cannot leave your time share or any right to use it to a partner;

  3. Your children, if you have them, must inherit it equally, you cannot exclude any children from this provision;

  4. In the absence of any children, ownership would pass to parents or siblings or even more remote further removed family

Also, in order to inherit, any UK based beneficiary would need to arrange an NIE number (like a National Insurance Number) and potentially, give Power of Attorney to a Spanish Solicitor (Abogado) to act on behalf of each beneficiary which clearly creates its own problems regarding travel, translation and cost.

You just need to let us know when you are next visiting your time share, and we will liaise with the notary closest to you to offer you some dates and times that might be convenient for you to attend.

Once notarised, the original Will is lodged in Madrid, and you are given a copy to take away with you.
