Significant Court of Protection application backlog is revealed

This week, Holly Mieville-Hawkins, Senior Associate at Enable Law, who specialises in mental capacity and is a member of The Law Society, said on LinkedIn:

“General #propertyandaffairs applications to the #courtofprotection are currently taking 48 weeks to process from start to end, and #deputyship applications are taking 27.4 weeks. This is hugely significant as behind each and every application is a person or a family experiencing distress and uncertainty.

“Applications for property and affairs deputyships have also risen 51.69% over the past 6 months, compared with the previous 6 months.

This is where your family will end up if you lose mental capacity and have not already organised your Lasting powers of Attorney (LPAs).

They don’t have to be registered straight away as when they are needed registration can be made via the Office of the Public Guardian, however, without your loved ones having the documents in their hands ready to be registered if needed, they will be forced to go to the Court of Protection with, in addition to the wait indicated above, fees in excess of £1000 to pay.

Make the smart choice, if you’re resident in the UK get your LPAs for Health and Welfare organised with your advance directive, including registration for just £545.

If resident in Spain and do not spend any significant time in the UK but do have bank accounts, investments or property in the UK, get your unregistered LPA for Property and Finance in place for just 99 Euros.

If you spend over 4 weeks in the UK then we would suggest including the LPA for Health and Welfare as well as your advance directive which will cost 297 Euros in total.

You will not wake up one morning and wish you HADN’T done this in advance, but your family may well wish you HAD if you ignore this vital advice at this time.
